Legal Framework

PERMIT for temporary residence is a confirmation of the right of a foreign citizen or a person without nationality to temporarily live in the Russian Federation before acquisition of registration certificate executed in the form of stamp in the identity document of a foreign citizen or a person without nationality or in the form of document of the established format that is issued in the Russian Federation to the person without nationality who has not a document which confirms his identity.

PERMIT for temporary residence can be issued to a foreign citizen within a quota that is approved by the Government of the Russian Federation. Expiration date of the permit for temporary residence is three years.

Permit for temporary residence is issued for a three-year period. A foreign citizen of age more than 18 can be issued a permit for temporary residence which is issued within a quota limits. The quota of issue of permit for temporary residence is annually approved by the Government of the Russian Federation based on the proposals of the executive authority of the entities of the Russian Federation with regard to demographic situation in the relevant entity of the Russian Federation and capacity of a particular entity to settle the foreign citizens.

A Permit for Temporary Residence in the Russian Federation contains the following data: name, surname (in Cyrillic and Latin letters), date and place of birth, sex, nationality, number and date of issue of the Permit, expiration date, name of the issuer (executive body of power).
The institution of temporary residence in Russia has been in effect since 2003. The Government of the Russian Federation approves annual quotas, issue procedure of temporary residence and list of documents to submit with an application for Permit for Temporary Residence.

Territorial body of the Federal authority of executive power responsible for internal affaires, based on application submitted to the given authority by the foreign citizen who temporarily arrives to the Russian Federation or based on application submitted by a foreign citizen in diplomatic representation or consular office of the Russian Federation in the country of living of the foreign citizen, with 6 month period issues to the foreign citizen permit for temporary residence or dismiss his application for such permit. A territorial body of the Federal authority of executive power responsible for internal affairs, when considering an application of foreign citizen for issue of permit for temporary residence directs the inquiry to the security bodies, health bodies, migration bodies and other bodies concerned which, within 2-month period from the date of such inquiry, shall provide information about lack of circumstances which would prevent the foreign citizens from issue of permit for temporary residence. In case foreign citizen’s application for permit for temporary residence is dismissed he has the right to repeatedly submit in the same order application for temporary residence not earlier than one year from the date of previous application. In accordance with Chapter 2 of the Federal Law On the Legal Status of the Foreign Russian Federation, permit for temporary residence is a confirmation of the right of a foreign citizen or a person without nationality to temporary live in the Russian Federation before acquisition of registration certificate. A permit for temporary residence is executed in the form of stamp in the identity document of a foreign citizen or a person without nationality or in the form of document of established format which is issued in the Russian Federation to a person without nationality who does not have the identity document.
PERMIT FOR TEMPORARY RESIDENCE OUTSIDE GOVERMENT'S QUOTA CAN BE ISSUES TO A FOREIGN CITIZEN PROVIDED THAT:
•	He/she was born on the territory of the RSFSR and had citizenship of the USSR in the past or born on the territory of the Russian Federation
•	Acknowledged to be disable and has disabled son or daughter who are citizens of the Russian Federation
•	He/she has at least one disable parent who is a citizen of the Russian federation
•	He/she is married to a citizen of the Russian Federation who has the residence place in the Russian Federation
•	Who joint military service for a period of military service
•	Person who made investments in the Russian Federation equal to the size determined by the Government of the Russian Federation (this requirement is not effective now)

Grounds For Dismissal Of Application And Extinguishing Of The Earlier issued Permit For Temporary Residence:
•	Actions aimed at violent change in the constitutional fundamentals of the power in the Russian federation, other actions which menace security of the Russian Federation or the citizens of the Russian federation.
•	Funding, planning terrorist (extremist) or direct involvement into committing such action as well as other actions which support terrorist (extremist) activities.
•	In course of five years prior to submission of application for issue of permit for temporary residence, there was an administrative exclusion out of the Russian Federation or deportation.
•	Presentation of foul or forged documents or presented false facts about himself/herself.
•	Convicted by effective decision of the court for committing serious or especially serious crime or offense, repetition of which is acknowledged to be dangerous.
•	Has an outstanding convictions or rehabilitation from serious and especially serious crime on the Territory of the Russian Federation or abroad which are acknowledged by the Federal Law of the Russian Federation to be such crimes.
•	Repeatedly (two and more times) during one year was liable to administrative proceedings for violation of the applicable law of the Russian Federation in provision of the requirements of stay (residence) of foreign citizens in the Russian Federation.
•	Cannot provide any evidence of ability to sustain himself/herself and his/her family in the Russian Federation within the limits of minimum sustenance without requesting for Government aid, except from those cases when a foreign citizen is acknowledged to be disabled.
•	After three years passed from exit from the Russian Federation does not have a living area in accordance to the applicable law of the Russian Federation.
•	Exit from the Russian Federation to any foreign state for permanent residence.
•	Is out of the territory of the Russian federation for more than six months.
•	Married a citizen of the Russian Federation which was a basis for permit for temporary residence, but marriage is acknowledged by court to be ineffective.
•	Suffers from drug abuse or does not have certificate of lack of disease provoked by HIV or suffers from one of the infectious diseases which present danger for people around. List of such diseases and procedure of confirmation of their presence or their lack is approved by the Government of the Russian Federation.
