Arrival Of Foreign Citizens

Immigration legislation of Russia binds foreign citizens to register their stay on the territory of the Russian Federation within three working days. Purpose of migration registration is to present for centralized registration addresses of stay of foreign citizens in Russia.

Registration of foreign citizens at place of stay is performed upon receipt by migration registration body of notices about their arrival at place of stay. Territorial authorities of Federal Migration Service enter the relevant information in state information system of migration registration.

Fact of departure of foreign citizens from the RF irrespective of duration of such departure is the reason for cancellation of migration registration. In case of new entrance registration procedure is to be carried anew.

Pursuant To New Federal Law
№ 109 dated 15.01.07

On November 18, 2006 State Duma approved in second reading draft legislation on penalties for illegal engagement of foreign work force. The relevant amendments are made into the RF Code "On administrative violations".

It is proposed to fix for foreign citizens and stateless citizens penalties for violation of rules of stay in the RF in the amount ranging from 10 to 15 minimum monthly wages (1 minimum monthly wage for penalty is equal to RUR 100) with or without administrative removal from the Russian Federation. The responsibility for the engaging party in case of non-compliance with the same obligations is established as follows: for citizens - in the amount ranging from 20 to 40 minimum monthly wages, for officers - from 400 to 500 minimum monthly wages, for legal entities - from 4000 to 5000 minimum monthly wages. However for legal entities this penalty is established for each foreign citizen or stateless citizen individually. We emphasize that at present the penalty is fixed for the fact of illegal engagement of foreign citizens irrespective of the number of foreign citizens employed.

Besides for violation of rules of entrance, transit or for absence of documents confirming the right for stay in the RF, the penalty in the amount of 20 to 50 minimum monthly wages with or without administrative removal from the Russian Federation. The same penalty is imposed if the employee presented in documents false purpose of stay in the Russian Federation or eluded departure. For carrying out of labor activity without work permit, if it is prescribed by the law it is proposed to impose penalty in the amount from 10 to 25 minimum monthly wages. In case obtaining of permit is regulated by federal standards the penalty in the amount from 10 to 50 minimum monthly wages is imposed.

Engagement and employment of foreign citizens in case of absence of work permit, if it is prescribed by the law, also results in administrative penalty. It amounts from 20 to 50 minimum monthly wages for citizens, from 2500 to 8000 minimum monthly wages for legal entities. Suspension of activity is also possible for legal entities for the period of ninety days.

In case of absence of permission of engagement of foreign employees, if it is obligatory in accordance with federal law, penalties are imposed on the engaging party as well. The penalties for the citizens amount from 20 to 50 minimum monthly wages, for officers - from 250 to 500 minimum monthly wages, for legal entities - from 2500 to 8000 minimum monthly wages.
